WARREN: After a status hearing Wednesday in Trumbull County Common Pleas Court, a case in Girard that could stop a proposed landfill from being built there was continued for another month.
Girard filed appropriation proceedings in the court of Judge Peter Kontos with the intent of seizing through eminent domain about 40 acres. The majority of the land is owned by the Ohio Central Railroad Co. and has an appraised value price of $41,000.
The city, represented by attorney Frank Bodor of Warren, met Wednesday morning in the hearing with legal counsel for the railroad.
Another status hearing has been scheduled for October 31st on 68 acres where the city says it wishes to follow a plan created in 2000 by the Trumbull County Planning Commission to create a park and recreation area there. The remaining acreage that runs along the Mahoning River are owned by the Ohio Leather Co.
However, Total Waste Logistics has applied to build a construction and demolition debris (C&DD) landfill on much of the same property. It lies behind the Creekside Golf Dome off U.S. Route 422.
Girard Law Director Mark Standohar and local attorney Kurt Latell are battling the landfill issue at the state level.
An appeal has been filed with the EPA's Environmental Review Appeals Commission against a previous ruling by the U.S. EPA, which stated that if a landfill is approved in the city, TWL's application would be grandfathered in and the company would not have to follow new, more stringent landfill regulations.
The city has never stated that its plan to seize the land by eminent domain has any connection with the landfill.
